APPLICATION FORM FOR THE PROTECTION OF PERSONAL DATA

Pursuant to the Law No. 6698 on the Protection of Personal Data (“Law”) and the relevant legislation, you have the opportunity to obtain information by applying to the data controller in writing to https://mulkiyet.com (“Institution”).

PURPOSE

With this application form, your personal data;

1. to learn whether your personal data is processed or not,
2. request information if processed,
3. to learn the purpose of processing and whether it is used in accordance with its purpose,
4. learning the parties to whom it is transferred domestically / internationally,
5. request correction if incomplete / incorrectly processed,
6. To request deletion/destruction within the framework of the conditions stipulated in Article 7 of the Law,
7. to request notification of the transactions made pursuant to subparagraphs (e) and (f) above to the third parties to whom it is transferred,
8. object to the occurrence of a result to your detriment due to analysis exclusively by automated systems,
9. you have the right to demand compensation for the damage in case you suffer damage due to unlawful processing.

APPLICATION PROCESS

Kurumumuz taleplerinizi, talebin niteliğine göre en kısa sürede ve en geç otuz gün içinde ücretsiz olarak sonuçlandırır. Ancak, işlemin ayrıca bir maliyeti gerektirmesi hâlinde, ücret alınabilir. Kurumumuz talebi kabul edip işleme koyabilir veya gerekçesini açıklayarak talebi yazılı usulle reddedebilir. Başvurunun Kurumumuz hatasından kaynaklanması hâlinde alınan ücret İlgili Kişi’ye iade edilir.

CONTENT OF THE APPLICATION

Our institution finalizes your requests free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, a fee may be charged. Our Institution may accept and process the request or reject the request by written procedure by explaining its reasoning. In case the application is caused by an error of our Authority, the fee charged shall be refunded to the Relevant Person.

EXCEPTIONAL CASES

On the other hand, since the following cases are not covered by the Law, the right to file a claim regarding these issues will not arise:

1. Processing of personal data by natural persons within the scope of activities related to themselves or their family members living in the same residence, provided that personal data are not disclosed to third parties and the obligations regarding data security are complied with.
2. Processing of personal data for purposes such as research, planning and statistics by anonymizing personal data with official statistics.
3. Processing of personal data for artistic, historical, literary or scientific purposes or within the scope of freedom of expression, provided that such processing does not violate national defense, national security, public security, public order, economic security, privacy of private life or personal rights or constitute a crime.
4. Processing of personal data within the scope of preventive, protective and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public security, public order or economic security.
5. Processing of personal data by judicial or enforcement authorities in connection with investigations, prosecutions, trials or executions.

In the following cases, only the right to claim compensation for the damage incurred will arise.

1. Processing of personal data is necessary for the prevention of crime or criminal investigation.
2. Processing of personal data made public by the data subject himself/herself.
3. Processing of personal data is necessary for the execution of supervisory or regulatory duties and disciplinary investigation or prosecution by authorized and authorized public institutions and organizations and professional organizations in the nature of public institutions based on the authority granted by law.
4. Processing of personal data is necessary for the protection of the economic and financial interests of the State in relation to budgetary, tax and fiscal matters.
